Bidding Terms and Conditions

NOTE: The terms and conditions listed below are the policies of Graham Lancaster Auctions. By bidding you are agreeing to these terms. The Auctioneer may amend these conditions in writing or by announcement before or during the auction.  

TERMS

The following terms are understood in these conditions: 

  • BIDDER: A person who participates and bids at Graham Lancaster Auctions. 
  • BUYER: The person with the highest bid accepted by the Auctioneer. 
  • LOT: An item or group described against a number in the catalogue and offered in the sale. 
  • HAMMER PRICE: The highest bid accepted by the Auctioneer, not inclusive of the buyer’s premium, internet bidding fees and credit card fees. 
  • BUYER’S PREMIUM: A fee calculated as a percentage of the hammer price, payable by the buyer as a part of the invoice total. 
  • RESERVE: The lowest bid the Auctioneer may accept on an item as instructed by the Seller. 
  • CONDITION REPORT: A detailed description of an item available by request in addition to the catalogue description. Photographs form part of the condition report. 
  • VALUES: All values in Graham Lancaster Auctions catalogues, estimates and invoices are Australian Dollars (AUD). 

BUYER CONDITIONS 

  1. CATALOGUE AND DESCRIPTION 
    Graham Lancaster Auctions catalogue descriptions are made in good faith as a statement of opinion. Prospective buyers are strongly encouraged to examine the item in person either at the auction viewing or by appointment. If the buyer is unable to evaluate the item in person, they should authorise a knowledgeable person to do so on their behalf or request a condition report from the Auctioneer. Neither the Auctioneer nor the Seller are responsible for any errors or omissions in the catalogue or description. Price estimates included in the catalogue are intended as a guide only and are not intended to be definitive.
     
  2. BUYERS RESPONSIBILITY 
    All items are sold as is, without warranty or guarantee offered by the Auctioneer or Seller except as legally required in the state the auction is held in. The buyer will either collect the goods upon payment or arrange collection or postage as soon as possible.  

AUCTION CONDITIONS 

  1. SAFETY 
    Graham Lancaster Auctions reserve the right to deny admission and participation to any person.
     
  2. REGISTRATION 
    Prospective buyers must register prior to bidding. Bidders intending to make payment by cheque will need to provide photo identification prior to bidding. 
     
  3. BIDDING 
    Bidders accept personal liability to pay the purchase price and any fees advised by the Auctioneer prior to bidding.
     
  4. ONLINE BIDDING 
    Graham Lancaster Auctions offers online bidding in conjunction with our online bidding provider. Online bidding will incur a 2.5% surcharge on the hammer price, which will be reflected on the invoice total. The auctioneer will take no responsibility for unforeseen technology failures or bidder error.
     
  5. ABSENTEE BIDDERS 
    The Auctioneer will make every effort to execute absentee bids received in writing via email or post until 3 days prior to each auction. If submitting absentee bids, please ensure the bid is confirmed as received by the Auctioneer.
     
  6. TELEPHONE BIDDERS 
    Telephone bidders will be accepted by prior arrangement with the Auctioneer on items with a minimum estimate of $500. In the event of requests for telephone bids exceeding the number of available telephonists, priority will be given to the earliest requests. Every effort will be made to contact bidders; however, Graham Lancaster Auctions accepts no responsibility in the event of failure to execute bids or unforeseen failures in communication. Telephonists will contact bidders on the day of auction and shortly before the requested lot is offered.
     
  7. RESERVE 
    Where the Seller has nominated a reserve price, the Auctioneer may not accept bids which do not exceed this price. The Auctioneer may open the bidding on any lot below the reserve by placing a bid on behalf of the Seller. If a lot does not meet its reserve, the bidder may negotiate a private sale with the Auctioneer after the auction has ended.
     
  8. BIDDING INCREMENTS 
    The Auctioneer reserves the right to refuse any bid or withdraw any lot from sale at any time prior to or during the auction. Bidding will advance in the increments set out below, however the Auctioneer may change these increments during the sale by advising the bidders.

  1. SUCCESSFUL BIDDERS 
    The highest bidder accepted by the Auctioneer at the conclusion of the sale enters a contract of sale between the Seller and the Buyer. Risk and responsibility for the lot passes to the Buyer at this time. 
     
  2. AUCTIONEER’S DISCRETION 
    The Auctioneer reserves the right to refuse any bid, to advance the bidding in any manner, to withdraw any lot and to end the bidding at his sole discretion. In the case of error or dispute, the Auctioneer’s decision will be final. The Auctioneer may reopen bidding, cancel the sale or resell the item at his sole discretion. 
     
  3. AUCTION RESULTS 
    Graham Lancaster Auctions prices realised will be published on our website after the auction has been finalised. The published prices reflect the hammer price exclusive of any premiums or fees.
     
  4. INTERNATIONAL BUYERS 
    Graham Lancaster Auctions welcomes international bidders; however, the Auctioneer takes no responsibility for export licences, customs fees, duties and associated costs. Buyers are responsible for consulting and abiding by Australia’s Protection of Moveable Cultural Heritage Act. All estimates, prices and invoice amounts are in Australian Dollars (AUD). 
     
  5. BUYERS PREMIUM 
    Graham Lancaster Auctions requires that successful bidders pay a buyer’s premium in addition to the hammer price. Unless otherwise advised, the buyer’s premium is 15% of the hammer price plus GST, totalling 16.5% of the hammer price. This premium will be included on the invoice and is not negotiable.
     
  6. GOODS AND SERVICES TAX 
    As is the practice in all states of Australia, Graham Lancaster Auctions will collect on behalf of the Australian Tax Office a Goods and Services Tax (GST) of 10% on all applicable transactions. GST is applicable on the hammer price in the case where the Seller is not an Australian resident or is selling property that is owned by an entity registered for GST. GST is also applicable on the buyer’s premium as detailed above.
     
  7. INVOICE PAYMENT 
    The total invoice amount will include the hammer price, buyer’s premium including GST and any applicable fees and charges. Additional fees may include credit card fee, online bidding fee, postage estimate if requested, postage insurance estimate if requested and packing costs. Packing service is usually charged at between $10-$30 depending on the size and number of items. Graham Lancaster Auctions will release the goods to the buyer when full payment has been received not later than 7 days after the invoice date. Payment can be made by cash, direct deposit, EFTPOS or credit card (Visa/Mastercard).
     
  8. COLLECTION OF GOODS 
    Graham Lancaster Auctions requires that all goods purchased be collected within 7 days of the auction, unless otherwise arranged with the Auctioneer. Postage is available on any item acceptable by Australia Post. If items are to be posted, Australia Post insurance will be included in the cost unless the buyer advises otherwise. Collection by a third party or courier service may be arranged by the buyer, however the Auctioneer must be notified in advance. 
     
  9. FAILURE TO COLLECT GOODS 
    Goods not collected withing 7 days of the auction may be removed from Graham Lancaster Auctions and placed into storage at the buyer’s expense. Goods will not be released until full payment is made for any costs incurred.
     
  10. REMEDIES FOR NON-PAYMENT 
    Graham Lancaster Auctions requires full payment no later than 7 days from invoice date. In the event that payment is not received, the Auctioneer may take the following actions: 
  • Charge the buyer interest at a reasonable rate at his sole discretion. 
  • Terminate the sale, in which case any deposit paid would be forfeited by the buyer. 
  • Initiate legal action against the buyer for recovery of the invoice amount and costs incurred. 
  • Resell the lot, in which case the defaulting buyer will be responsible for any shortfall in price along with fees, costs and commissions for the reselling. 
  • Cancel the buyer’s registration with Graham Lancaster Auctions in any future auction. 
  1. WARRANTY AND RETURNS 
    Graham Lancaster Auctions endeavours to ensure all lots are as described in the catalogue and depicted in the accompanying photographs. All auction lots are sold as is, and neither the Seller nor the Auctioneer accepts any responsibility or liability except as required by the law in the state in which the auction is held. Returns will not be accepted, except in the case that a lot is significantly different to the description given and express permission has been given by the Auctioneer. 
  2. COPYRIGHT 
    Graham Lancaster Auctions retains ownership of all text, photographs, video and logos it creates. This content may not be reproduced, printed, displayed, published or distributed without the express written permission of Graham Lancaster Auctions. 

Post Auction Information

Absentee bidders are requested to refrain from making outcome inquiries until at least 2 business days post-auction. Prices Realised will be promptly posted on our website once data entry is confirmed. Please allow several days for Absentee bidder invoices, as parcels require packing and weighing for accurate postage costs. We appreciate your patience in delivering timely auction results and invoices.
